1. Acceptance of Terms

By downloading, installing, or using the KidneyPal mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

KidneyPal is a mobile application designed to help users manage their kidney health by:

• Analyzing meal photos using artificial intelligence to estimate nutrient content
• Tracking daily intake of potassium, phosphorus, sodium, and protein
• Providing kidney-safe food swap suggestions
• Offering personalized insights based on your dietary patterns

3. Medical Disclaimer and Informational Purpose

IMPORTANT: PLEASE READ THIS SECTION CAREFULLY. KIDNEYPAL IS NOT A MEDICAL DEVICE, DOES NOT PROVIDE MEDICAL ADVICE, AND IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL CARE.

KidneyPal is a reference and informational tool only. All information provided by the App — including but not limited to AI-generated meal analyses, nutrient estimates, kidney safety scores, food ratings, chat responses, recipes, dietary suggestions, smart swap recommendations, and reports — consists of rough estimates and approximations that may be incomplete, inaccurate, or incorrect. This information is provided for general informational and educational purposes only and should never be relied upon as the sole basis for any dietary, health, or medical decision.

3.1 AI-Generated Content — No Guarantee of Accuracy

The App uses artificial intelligence (including third-party AI models) to analyze meals, estimate nutrients, generate recipes, and respond to questions. AI-generated content is inherently imprecise and may contain significant errors, omissions, or inaccuracies. Nutrient values, safety scores, portion estimates, and all other AI outputs are best-effort approximations — not laboratory measurements. You must independently verify all information with qualified healthcare professionals before acting on it.

3.2 Nutrient Estimates Are Approximations

The nutrient values displayed in the App (including sodium, potassium, phosphorus, protein, calories, and all other nutrients) are estimates only. Actual nutrient content may vary significantly based on preparation methods, cooking techniques, portion sizes, specific brands or varieties of ingredients, seasonal variations, and many other factors that the App cannot account for. You should not rely on these estimates for critical dietary decisions, especially if you have been prescribed specific nutrient limits by your healthcare provider.

3.3 Not a Substitute for Professional Medical Care

KidneyPal does not diagnose, treat, cure, or prevent any disease or medical condition. The App does not replace the advice of your physician, nephrologist, registered dietitian, or any other qualified healthcare professional. Recommended nutrient limits shown in the App are based on general clinical guidelines and may not reflect your individual medical needs. Your prescribed limits may differ based on your lab results, medications, dialysis schedule, comorbidities, and overall health status.

3.4 Your Responsibility

You use KidneyPal entirely at your own risk. You are solely responsible for your dietary choices and health decisions. You should always consult with your physician, nephrologist, or registered dietitian before making any changes to your diet or treatment plan. Never disregard professional medical advice or delay seeking it because of information you obtained from the App.

4. User Accounts

To use certain features of the App, you must create an account. You agree to:

• Provide accurate and complete information during registration
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

5. Subscription and Payments

KidneyPal offers both free and premium subscription tiers:

• Free Tier: Limited to 3 meal scans per day with basic analysis features
• Premium Tier: Unlimited scans, advanced analysis, smart swaps, and personalized insights

Premium subscriptions are billed through the Apple App Store or Google Play Store. Subscription management, cancellation, and refund requests must be handled through your respective app store account.

6. User Content

By uploading photos or other content to the App, you grant KidneyPal a non-exclusive, worldwide license to use, process, and analyze such content for the purpose of providing our services. We will handle your content in accordance with our Privacy Policy.

7. Prohibited Uses

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's functionality
• Reverse engineer, decompile, or disassemble the App
• Share your account credentials with others
• Use the App to provide medical advice to others

8. Intellectual Property

The App, including its design, features, and content, is owned by KidneyPal and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our written permission.

9. Disclaimer of Warranties

THE APP AND ALL CONTENT, FEATURES, INFORMATION, AND SERVICES PROVIDED THROUGH THE APP ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, KIDNEYPAL, PRESTIGE WORLDWIDE APPS LLC, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• ANY WARRANTY THAT THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
• ANY WARRANTY REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY NUTRIENT ESTIMATES, FOOD ANALYSES, SAFETY SCORES, AI-GENERATED CONTENT, OR OTHER INFORMATION PROVIDED THROUGH THE APP
• ANY WARRANTY THAT THE RESULTS OBTAINED FROM THE USE OF THE APP WILL BE ACCURATE, RELIABLE, OR SUITABLE FOR ANY PURPOSE

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE APP IS AT YOUR SOLE RISK. No information or advice, whether oral or written, obtained by you from KidneyPal or through the App shall create any warranty not expressly stated in these Terms.

10. Assumption of Risk

You voluntarily assume all risk associated with your use of the App. You acknowledge and agree that:

• All nutrient values, kidney safety scores, food ratings, and dietary information provided by the App are estimates that may be significantly inaccurate
• AI-generated analyses and recommendations can and do produce errors, including potentially dangerous errors for individuals with kidney disease or other medical conditions
• The App is not a substitute for laboratory testing, professional dietary counseling, or medical supervision
• You are solely responsible for verifying any information from the App with your healthcare team before relying on it
• KidneyPal bears no responsibility for any adverse health outcomes, dietary complications, or other harm resulting from your use of or reliance on information provided by the App

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KIDNEYPAL, PRESTIGE WORLDWIDE APPS LLC, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND, including but not limited to damages for loss of profits, goodwill, health, data, or other intangible losses, arising out of or in connection with:

• Your use of, reliance on, or inability to use the App
• Any errors, inaccuracies, or omissions in nutrient analysis, food ratings, safety scores, or any other information provided by the App
• Any health issues, adverse reactions, dietary complications, or medical emergencies that may arise from dietary choices made based on information from the App
• Any AI-generated content, recommendations, or responses that are incorrect, misleading, or incomplete
• Any loss of data or unauthorized access to your account
• Any interruption, suspension, or cessation of the App's services
• Any third-party conduct or content accessed through the App

IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF KIDNEYPAL AND PRESTIGE WORLDWIDE APPS LLC FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

12. Indemnification

You agree to indemnify and hold harmless KidneyPal, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes through the App or via email. Your continued use of the App after such changes constitutes acceptance of the modified Terms.

14. Termination

We may terminate or suspend your account at any time for violations of these Terms or for any other reason at our discretion. You may delete your account at any time through the App's settings.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
